A couple in Miami, Florida recently won a personal injury claim arising from a car accident in 2004. The couple was involved in an accident along the Interstate 95 in Miami, near the Golden Glades Interchange when another driver crashed into their car after colliding with an 18-wheeler oil tanker.
Both victims suffered injuries arising from the collision and tried to claim damages from the other drivers. The driver of the car which hit the couple’s, who was found primarily responsible for the accident, did not carry any insurance, while the truck driver was underinsured.
The couple turned to their own insurance policy which contained a clause that provided benefits in cases involving uninsured or underinsured motorists. The insurance company denied their claims for damages, prompting the couple to file a lawsuit for damages.
The jury upheld the claims of the ciyoke which were based on the uninsured/underinsured motorist benefits that Florida laws allow insurance companies to offer. They awarded the couple almost $14.5 million as compensation for medical expenses, past and future lost earnings, pain and suffering, and loss of consortium suffered by Carrie Zucker arising from her husband’s injuries.
Florida tort law allows persons who are injured in accidents to pursue compensation against the parties responsible for their injuries. An issue can arise when the motorists involved are uninsured or underinsured, jeopardizing the rights of a severely injured victim to recover the maximum value of compensation to which they are legally entitled.
